The book has been substantially updated to cover wide-ranging recent developments in international business and trade law. In particular, the problems on trade law are updated to reflect developments associated with the Trump administration, including imposition of new tariffs, U.S.-China trade disputes, threats to the WTO dispute settlement system’s Appellate Body, and NAFTA renegotiations leading to the U.S.-Mexico-Canada Agreement (USMCA). This chapter also contains revised problems for free trade agreements in light of the Trans-Pacific Partnership and USMCA developments, and for environmental/conservation laws and food safety laws in light of recent WTO jurisprudence and new disputes. The exports chapter is updated to account for the Export Control Reform Act of 2018 and new developments regarding the Cuba embargo and the Boycott, Divestment, Sanctions (BDS) movement fostered by the UN Human Rights Council. The technology chapter has added new material on U.S.-China disputes and retaliation concerning forced technology transfers. For foreign investment, the new edition adds a problem on bilateral investment treaties, substantially updates the problem on investment approvals in light of new U.S. legislation, and includes new material on recent litigation and arbitration of expropriation claims.
