The Fifth Edition contains 11 new primary cases, most of which substitute for older cases on the same topics. The text and notes after cases have been fully updated to reflect changes in ethics rules and developments in case law; there are dozens of citations to cases decided since the last edition was published. All citations to the ABA Model Rules, ABA Judicial Code, and state ethics rules (including California’s new rules) are current. The structure of the book’s chapters remains unchanged, although we have beefed up coverage of public-interest practice; malpractice in transactional matters (as opposed to litigation matters); the crime-fraud exception to the attorney-client and work-product privileges; and conflicts of interest caused by lawyers who move from one firm to another.
