The casebook proceeds in the familiar doctrinal order while emphasizing how tort disputes are actually litigated and resolved. Instructors can begin either with intentional torts or negligence. Chapter 1 provides an overview of trial court procedure in tort cases to anchor doctrinal study in procedural realities. Chapter 2 offers a concise treatment of intentional torts and defenses.
