Students learn law better if they use it in simulation exercises. This book contains 14 case files with realistic documents that an attorney practicing property law could encounter. The files cover topics commonly taught in the basic property course: adverse possession; gifts; estates and future interests; cotenancies; marital property; landlord-tenant law; real property sales; mortgages; easements; covenants; nuisance law; eminent domain; and takings. Students can use these files for 22 simulation exercises, focusing on the core skills of negotiation and advocacy.

  • 14 exercises provide basic instruction on negotiation, teaching students how to use substantive law to enhance their bargaining positions.
  • Six exercises provide basic instruction on advocacy, focusing on use of law in closing arguments after trial.
  • Two exercises allow students to participate in complete one-hour jury trials.
  • The comprehensive teacher’s manual provides guidance on: (a) how to use the exercises without reducing course coverage; (b) the substantive issues involved in each exercise; and (c) efficient methods for assessing student performance.
  • The case files can also be used to teach foundational lawyering skills in preparation for the Uniform Bar Exam.

The author has made various changes in the second edition. Most notably: (a) there are two new chapters (Landlord-Tenant: Second Exercise; and Mortgages); (b) the chapter on takings (previously Ch. 12, now Ch. 14) has been extensively revised in light of changes in the law; (c) the text now includes a step-by-step approach to teaching oral advocacy, which parallels the step-by-step approach to teaching negotiation which was already in the first edition; and (d) all the advocacy exercises can now be used as negotiation exercises as well. While the first edition had 12 exercises, this new edition contains 20 exercises.
