This casebook provides an introduction to the legal relationships between American Indian tribes, their citizens, the federal government, individual states, and others. The foundational cases are incorporated with statutory text, background material, hypothetical questions, and discussion problems to structure the classroom experience and enhance student engagement. History is critical to understanding American Indian law as it now exists and it is covered and explained to highlight how it shapes current law. The fourth edition includes expanded materials on law and order within Indian country, the Indian Child Welfare Act, water rights, Hawaii, and Alaska as well as recent Executive Branch actions that increase tribal authority. The authors update the book with a supplement after the end of the Supreme Court’s term every summer.

This edition of the book includes updated cases, statutes, regulations, and analyses since the 2015 publication.

The Supreme Court continued to be very active in the Indian law field––handing down seven decisions. The addition of Justice Neal Gorsuch brought a conservative perspective that has so far been favorable to tribal interests. The cases are all covered.

The book includes an updated graphic analysis of Indian law cases during the Roberts Court to help readers see the big picture.

Federal and state appellate courts decided many important cases on issues ranging from the Indian Child Welfare Act to tribal taxation immunity, and tribal jurisdiction over nonmembers, which are included.

Also included are amendments to the tribal energy policy act that provide a path to greater self-determination in the natural resources context.

Important water rights cases from state and federal courts are included as principal cases with discussion, questions and analysis.

The Indian Child Welfare Act section was updated to include Obama-era regulations as well an appellate decision upholding them and the statute itself in the face of a broad constitutional challenge.

Recent Canada Supreme Court cases are discussed in notes the International comparative law chapter.
