The second edition of this book updates and explains the main legal precedents and concepts that undergird American postsecondary education, incorporating a thorough analysis of the principles and rules that govern the operation of colleges and universities. It is authoritative and multi-layered, examining the wealth of case law impacting institutions, administrators, faculty, and students, as well as the key issues and trends in the development of that case law. Some of the major topics covered in the first edition of this book have been revised and updated given the substantial changes in the law handed down by the U.S. Supreme Court, federal appellate courts, and some state supreme courts in recent years. Those topics include academic freedom, faculty speech and expression, race and affirmative action, Title VII and Title IX, and religion in higher education, to name just a few. The second edition captures the essence of the ideological and directional shift by the U.S. Supreme Court during the past twenty-five years and highlights the major changes that have taken place in the area of higher education law since the publication of the original precursor to this book titled College and University Law, published by the Michie Law Publishers, Charlottesville, Virginia, in 1972.
