The world of e-discovery and digital evidence has changed dramatically in the seven years since the first edition of this Nutshell. For the Second Edition, the authors have completely updated the original version, including brand new chapters on anticipated changes to the Federal Rules of Civil Procedure governing ESI (which take effect in December, 2015), technology assisted review of ESI, and the use of ESI in criminal cases. Other chapters have been substantially rewritten to bring the text up to date. This nutshell is a must own for both civil and criminal practitioners. It summarizes the current law on preservation, document collection and production, privilege protection, sanctions, and the ethical obligations of attorneys with respect to understanding and using technology.
