Cases and Materials on The Rules of Evidence
This title is a part of our CasebookPlus™ offering as ISBN 9798887867267. Learn more at Faculty-CasebookPlus.com.
This concise casebook offers materials that are thorough yet brief, enabling coverage of all the major topics in a three- or four-credit format. The emphasis is decidedly on primary materials: well-edited principal cases, followed by notes that inform the student on important details and developments. Within the chapters and sections, the materials generally follow the sequence of the Rules. The 9th edition retains all of the cases from the 8th edition, except Paredes v. State, which was replaced by Smith v. Arizona, 602 U.S. 779, 144 S.Ct. 1785 (2024), which effectively overruled Paredes.

List of the most notable changes in Wellborn and Cook, Evidence 9th edition:
In Chapter 1, §1, Old Chief v. United States, which had been discussed exclusively in the notes section in the 8th edition, is now a featured case in this chapter.
In Chapter 2, §1, United States v. Lasley is a new featured case and is now the first case in the Hearsay section.
Chapter 3, titled “Confrontation Clause,” is a new chapter. Previously, discussion of the Confrontation Clause was included within Chapter 2. Two cases, Crawford v. Washington and Davis v. Washington, which were featured cases in Chapter 2 of the 8th edition, are now the first two cases in the new chapter 3.
In Chapter 3, Michigan v. Bryant is the third featured case in this new chapter. The 8th edition had limited its discussion of that case to the notes section.
In Chapter 3, Smith v. Arizona, decided in 2024, is the fourth featured case in this new chapter. It replaced Paredes v. Arizona, which was effectively overruled by Smith.
The 9th edition contains some minor adjustments to the notes sections.
The 9th edition has added an Appendix, which contains the most recent version of the Federal Rules of Evidence. The 8th edition did not have an Appendix.
